Golden Chart Health – Terms of Use
Agreeing to these terms
These Terms of Use are an agreement between you and Goebel Biz, LLC ("we," "us"), which runs Golden Chart Health at goldencharthealth.com. By creating an account or using Golden Chart Health, you agree to these terms and to our Privacy Notice. If you don't agree, please don't use the service.
Who can use Golden Chart Health
- You must be 18 or older to create an account. You confirm this when you sign up.
- A parent or legal guardian may keep a profile for their child and is responsible for that profile.
- Give us accurate account information, and keep your password private. You are responsible for activity on your account.
- Tell us right away at contactus@goldencharthealth.com if you think someone has used your account without permission.
What Golden Chart Health is and is not
Golden Chart Health is a tool for recording health information and sharing it with the people you choose.
- Not medical advice. We don't diagnose, treat or recommend anything. Notes such as "outside your typical range" are reminders to talk with your doctor, not medical opinions. Always follow your doctor's advice.
- Not an emergency service. In an emergency, call 911.
- Not a legal document. Your NO BLOOD and DNR banners, emergency page and cards are not a legal medical order. Emergency crews generally follow your state's official signed forms, such as a POLST or advance directive. Keep those forms complete and easy to find.
- No guarantee anyone will look. We can't promise that EMTs, hospital staff or anyone else will see your lock screen, scan your QR code, or read your emergency page or directive.
- Not your medical record. We don't connect to your doctor's or hospital's records. Information is only as complete and accurate as what you and the people you invite enter.
Your information and your responsibilities
- You own your information. You give us permission to store, display and share it only as needed to run the service for you, as described in our Privacy Notice.
- Keep it accurate. You are responsible for what you and the people you invite enter, including readings, medicines, allergies and emergency information. Review your emergency information and printed cards regularly.
- Other people's information. Only add another person's health information, or someone's contact details, if you have their permission or the legal right to do so (for example, as their caregiver or guardian).
- People you invite can see and, depending on their access level, add information. Only invite people you trust. You can remove anyone's access at any time.
- Your emergency page can be seen by anyone with the QR code or link while it is turned on. Lock-screen images and printed cards can be seen by anyone who sees your phone or card. You choose what they show.
Free and paid plans
- Free for every profile: the emergency profile, signed directive upload, emergency QR page, wallet card, fridge sheet and lock-screen image.
- Paid, per profile: tracking, charts, doctor reports and sharing for that person cost $4.99 per month per profile, billed monthly. There is no free trial.
- Managing is free. A caregiver or family member does not pay to help someone. Anyone with access may choose to pay for a profile; no one is required to.
- Payments are processed by Stripe and renew automatically each month until cancelled. You authorize us to charge your payment method each month.
- Cancelling: you can cancel anytime in the app. Paid features stay on until the end of the month you already paid for. We don't give refunds for partial months, unless the law requires it.
- If payment stops or the person paying is removed, the profile keeps paid features for 30 days. After that, tracked information becomes read-only until someone subscribes again. Emergency features always keep working.
- Price changes: we will tell you at least 30 days before a price change takes effect. You can cancel before it does.
Acceptable use
Please don't:
- Add someone's information without their permission or legal right
- Use another person's account, or share your password
- Pretend to be someone else, or enter false emergency information
- Try to get into accounts, profiles or data you don't have access to
- Interfere with the service, overload it, or copy it with automated tools
- Use Golden Chart Health for anything illegal, harmful or harassing
Our service
- Availability. We work to keep Golden Chart Health running, but it may sometimes be unavailable for maintenance, outages or reasons outside our control. Don't rely on it as your only copy of important information. Keep paper copies of your directive and medicine list.
- Changes. We may add, change or remove features. We will tell you ahead of time about changes that significantly affect paid features.
- Closing your account. You can delete your account at any time in the app. Your information is then deleted as described in our Privacy Notice.
- If we close an account. We may suspend or close an account that breaks these terms or puts others at risk. When possible, we will tell you first and give you time to save your information.
- If we stop the service. We will give at least 60 days' notice and a way to save your information.
Disclaimers and limits on liability
Golden Chart Health is provided "as is" and "as available." To the fullest extent the law allows, we make no promises that it will be error-free, always available, or meet every need.
To the fullest extent the law allows, Goebel Biz, LLC is not responsible for:
- Medical decisions or care, including whether anyone reads or follows your emergency information, banners or directive
- Information entered by you or people you invite
- Problems caused by your device, internet connection, phone settings or lost or stolen devices
- Indirect or consequential losses
If we are found responsible for something, our total liability is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is greater. Some states don't allow certain limits, so some of these may not apply to you.
Disputes and governing law
If you have a concern, please email contactus@goldencharthealth.com first. Most problems can be solved quickly that way.
These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. Any dispute that we can't resolve informally will be handled in the state or federal courts located in Deschutes County, Oregon, unless the law where you live gives you the right to bring it elsewhere. Nothing in these terms takes away rights you have under consumer protection laws.
Changes to these terms
We may update these terms. If we make important changes, we will tell you in the app or by email before they take effect, and may ask you to agree again. The date at the top shows when these terms were last updated. If you keep using Golden Chart Health after changes take effect, you agree to the updated terms.
If any part of these terms can't be enforced, the rest still applies. These terms and our Privacy Notice are the full agreement between you and us about Golden Chart Health.
